Special Proceedings

The 1997 Rules of Civil Procedures define a special proceeding as “a remedy by which a party seeks to establish a status, a right, or a particular fact.”

 

It is distinct from an ordinary legal “action” where one party files a suit against another party to seek redress for a wrong or an injury, or to protect the suing party’s rights.

Tiburcia Manahan vs Engracia Manahan

G.R. No. 38050           September 22, 1933

 

This is an appeal taken by the appellant herein, Engracia Manahan, from the order of the Court of the First Instance of Bulacan dated July 1, 1932, in the matter of the will of the deceased Donata Manahan, special proceedings No. 4162, denying her motion for reconsideration and new trial filed on May 11, 1932.

Antonio Ragudo vs Emelita Pasno

G.R. No. L-16642      April 18, 1962

 

Appeal from an order dismissing plaintiffs' complaint.

In the Quezon Court of First Instance, the spouses Antonio Ragudo and Eugenia Paderes filed this complaint on October 12, 1959, to annul the order of the justice of the peace of Tayabas, same province, declaring Emelita R. Pasno their adopted child, which order, dated July 31, 1959, was already final.
